are felt now. “Foreclosure”, “short sale” and “deed in lieu” are the new buzz words. Unmarketable
property titles, liens, and uninhabitable properties are an everyday
concern.
If you are buying or selling a home, having a real estate attorney is just as
important as having a realtor. Real estate attorneys don’t guess about legal matters, they have to
know. It is common for parties to get to the closing table and have something unexpected ruin the
deal. Surprises are not welcome at the closing table. If you are buy or selling a home it is
essential that you have an attorney represent you. Many times, an attorney may pay for himself by
negotiating fees in your favor.
If you’re buying a home, your attorney
will:
• Help you understand the contract.
• Advise you on the best way to title your property depending on your specific situation.
• Prepare and register all the legal documents.
• Check that there are no covenants, easements, liens, etc. registered against the property that
will affect your use of it.
• Verify the mortgage documents to ensure you get the terms you were promised.
• Assess the adjustments, including taxes owing and utilities costs paid, prior to the transaction
closing.
• Attend the closing and review all the papers you will be required to sign.
• Arrange title insurance to protect you in case of a title defect.
If you’re selling a home, your attorney
will:
• Review the binder and prepare the purchase and sale agreement, including
negotiating its terms.
• Prepare the deed.
• Deal with title issues as they arise and correct
them.
• Attend the closing and review all the papers you will be
required to sign.
• Arrange for transfer of security deposits.
• Arrange for insurance certificates if
needed.
