When you’re a single parent or are raising children on your own due to divorce or death, there are a number of important considerations when it comes to protecting your children’s future well-being. Although you may be in perfect health today, of course there is no way to predict what may lie ahead.

The very best way to plan for your children’s future is to create it today. For many mothers, by making the choices in advance, conflicts can be eliminated or minimized that might occur over who will care for their children and handle their funds.

Estate planning for a single parent means ensuring that your children are protected and provided for in the event you are no longer able to care for them. Of particular importance to those who have experienced a divorce, it is vital to assess your assets and have your finances in order to make sure your plan works precisely the way you want.

A will is crucial for single parents. Your will not only states how your assets will be distributed in the event of your death, but it can be used to name your choices for the guardianship of your children due to either incapacity or death. The person you name as guardian will care for your children and make personal or financial decisions for them.

Leaving assets in a trust for your children is a great option. A trust is an invaluable legal tool that allows you to coordinate and control your estate, both while you are alive and then by passing it rapidly upon your death by avoiding probate.

You have control and can choose and set the conditions in the trust’s provisions. In the case of divorce, you select the trustee, and can therefore choose someone other than your ex-spouse to manage these assets. Additionally, money in a trust isn’t required to be distributed in a lump sum to your child when they reach the age of eighteen and may not have the maturity to handle their finances wisely.

He also chairs the Endowment Committees for ARC Broward and 211 Broward, Chaired the March of Dimes Signature Chef Gala, the 14th Annual Joint Tax and Estate Planning Seminar and the 211 Broward Making Real Connections Breakfast.

Jennifer Gomez, Esq. is an attorney admitted to practice in Florida and New York. Michael N. Segall, Esq. is a partner at the law firm of Wild Felice & Partners located in Plantation, Florida. He concentrates his practice in the areas of estate planning, estate and trust administration, business succession planning and asset protection.

Mr. Segall received his B.B.A. with a concentration in finance from The George Washington University in 2010 and a J.D. from Nova Southeastern University Shepard Broad College of Law in 2013, graduating magna cum laude. He went on to receive his LL.M. in Taxation from the University of Florida Levin College of Law in 2014.

Heather Lee O’Keefe
Legal Assistant

Heather Lee O’Keefe is the legal assistant to the managing partner of WFP Law, Michael D. Wild. Heather is pursuing her Juris Doctor degree at Nova Southeastern University Shepard Broad College of Law. She will finish her degree in May 2021 as one of the youngest students in her class. Heather is one of only 18 students accepted into the NSU Law Honors Program.

At NSU Law, Heather is greatly involved as an executive board member of multiple student organizations. She is the Vice President of the Real Property, Probate, & Trust Law Society; Director of Public Relations for the Transactional Law Practice Group; Director of Social Media for the Sports & Entertainment Law Society; Elections Committee Representative for the Student Bar Association; and Head Associate of LexisNexis on campus.
